1. Agreeing to these terms

These terms are an agreement between you and TeeOff Club (“TeeOff Club”, “we”, “us”). They apply when you use the TeeOff Club app or this website. By using either, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use TeeOff Club.

2. Using TeeOff Club

TeeOff Club lets you keep score during a round of golf, play and compare scores with friends, run competitions and Stableford events, log range practice, and look up golf clubs and tournaments. You can score rounds without an account. Some features, such as playing with friends, a profile and backing up your rounds, need you to sign in.

You must be at least 13 years old to use TeeOff Club. If you are under the age of majority where you live, you should have a parent's or guardian's permission.

3. Your account

• You sign in with your Apple ID. Keep your device and Apple ID secure, because anything done through your account is treated as done by you.
• Use your real name, or a name your playing partners will recognise, and don't pretend to be someone else.
• Tell us straight away at willardshikami@gmail.com if you think someone else has used your account.

4. Your content

Your scores, rounds, profile details and photo belong to you. So that we can run the app, you give us permission to store, copy and display them in the app, including to the other players in your round and, if you turn on “Broadcast to club”, to members of your home club. This permission ends when you delete the content or your account, except for scores that stay on another player's card as described in our Privacy Policy.

You are responsible for what you add. Don't upload a profile photo or enter a name that is offensive, misleading, or that you don't have the right to use.

5. Playing with others

• Only add other people to a round, or enter their details as a guest, if they are happy for you to do so.
• Everyone in a round can see everyone else's names, handicaps and scores for that round.
• The host of a round decides who is in it and when it ends.

6. Fair play

Golf runs on honesty, and so does TeeOff Club. You agree not to:

• Harass, abuse or impersonate other people
• Add people to rounds or search for them to bother them
• Try to get into other people's accounts or information, or into parts of the service you are not meant to reach
• Copy, scrape or collect information about other users or the club directory in bulk
• Interfere with, overload or try to break the app or our systems
• Copy, change or reverse engineer the app, except where the law allows it
• Use TeeOff Club for anything illegal

If you break these rules we may remove content, limit what you can do, or close your account.

7. Scores and handicaps

Net scores, Stableford points and other figures in the app are worked out from the scores and handicaps entered by players. They are for fun and for your own records. They are not an official handicap, and they are not official results for any club, golf union or tournament unless the organiser tells you otherwise. Always follow the Rules of Golf and your club's local rules on the course.

We don't check the scores people enter, and we are not responsible for disagreements between players about scores, results or any prizes or bets between them.

8. Club and tournament information

The club directory and tournament calendar currently cover Kenya. We gather this information from clubs' own websites and other public sources and try to keep it up to date, but we can't promise it is always complete or correct. Check with the club before you travel, book or enter a tournament.

Listing a club or tournament doesn't mean it endorses TeeOff Club or that we are connected to it. Club names, logos and photos belong to their owners. Tee times are booked with the club directly, not through us. If you represent a club and want something changed or removed, email us.

9. Apple Health and your wellbeing

If you choose, TeeOff Club can save range sessions to Apple Health as golf workouts. This is for your own records only. TeeOff Club is not a medical device and does not give medical advice. Golf is a physical activity; play within your limits and look after yourself on the course, including in hot weather.

10. Our app and brand

The app, this website, the TeeOff Club name and logo, and everything we create for them belong to us. We give you a personal, non-transferable permission to use the app on devices you own or control, for your own non-commercial use, while you follow these terms.

If you send us ideas or feedback, we may use them to improve TeeOff Club without owing you anything.

11. Changes and availability

We are always working on TeeOff Club, so features may change, be added or be removed. We try to keep the app running smoothly but can't promise it will always be available or free of errors. Rounds scored without signing in are only stored on your phone, so they can be lost if you delete the app or lose your phone.

We may update these terms. We will change the date at the top when we do, and if the changes are significant we will tell you in the app. If you keep using TeeOff Club after changes take effect, you accept the new terms.

12. Ending your use

You can stop using TeeOff Club at any time, and you can delete your account in the Profile tab. We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to for legal reasons. If we stop offering TeeOff Club altogether, we will give you reasonable notice where we can.

13. Liability

TeeOff Club is provided “as is”. To the extent the law allows, we don't give any promises about the app beyond those written in these terms.

To the extent the law allows, we are not responsible for indirect or unexpected losses, lost data, or anything that happens on the golf course, including injuries, damage to property or disputes between players. Where we are responsible, our total liability to you is limited to the greater of the amount you have paid us in the last twelve months and 5,000 Kenyan shillings.

Nothing in these terms limits any rights you have under consumer protection law that can't be limited by agreement, or our responsibility for death or personal injury caused by our negligence, or for fraud.

14. Apple

If you downloaded TeeOff Club from the App Store, these terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no duty to provide support for it, and is not responsible for any claims relating to it, including product liability, legal or regulatory claims, or claims that the app infringes someone else's rights. If the app fails to meet any promise that applies to it, you may tell Apple, and Apple may refund the price you paid, if any. Apple and its subsidiaries can enforce these terms against you. You must also follow the App Store's terms when you use the app, and you confirm you are not in a country subject to a United States government embargo, and are not on any United States government list of restricted parties.

15. Governing law

These terms are governed by the laws of Kenya. If there is a disagreement, we would much rather sort it out with you directly, so please email us first. If we can't, the courts of Kenya will deal with it, unless the law where you live gives you the right to go to your local courts.

If any part of these terms can't be enforced, the rest still applies. If we don't enforce part of these terms straight away, we can still enforce it later.
